Dealing with Contentious Executries

When someone dies it is the responsibility of their executor to wind up their estate and distribute their assets in accordance with the deceased’s will (or the laws of intestacy if there is no Will). andrew

In the majority of cases this is a relatively straight forward, albeit time consuming job. However, there are occasions where complex or contentious issues arise in relation to the administration of an estate, such as inheritance disputes or a missing will, and in these cases expert legal advice is essential.

At Murray Beith Murray our executry group has considerable experience in finding solutions for such difficult or contentious situations, using our technical knowledge combined with skills in negotiation and advocacy to obtain the best possible outcome for our clients.

One case we are currently assisting with involves the provision of advice to the executors of an estate valued at tens of millions of pounds. The executors found themselves facing numerous issues in administering this estate, including assets being located in four different legal jurisdictions, the repayment of extensive financing arrangements and the need to reach agreement with beneficiaries over a tax efficient distribution of the estate

Working with a number of other professional advisers, our specialist executry solicitors have helped our clients to resolve many of these complex issues and we continue to support them in reaching full settlement of the estate.

Our services were also requested in another case, where the client asked that our executry lawyers use their knowledge and experience to review work carried out by local lawyers to wind up a Testamentary Trust following the death of his relative.

Our review identified errors in the original inheritance tax liability and Legal Rights calculations and saved the client around £80,000.
