Advances in medicine, better diet, improvements in housing and social conditions – these factors and more are driving up average life expectancy. As we live longer, and more of us reach important age milestones, older people and their families face different challenges, such as ensuring that they get the care they need to enjoy a comfortable retirement, or planning for a time when someone they trust might have to make decisions on their behalf. When facing such issues, it is important to have a specialist solicitor involved who will make sure that you are fully informed of the options available and the potential consequences.

At Murray Beith Murray, we recognise the need for specialist legal services for older people and their families, which is why we offer a dedicated Later Life Service, delivered by sensitive, caring and experienced professionals. We are trusted advisors to many families, working with them across generations and our experience includes providing support and guidance on:

  • Powers of Attorney and Guardianship – Powers of Attorney ensure that our affairs, whether financial and/or welfare, can be looked after in the event of our incapacity. We provide advice on granting Powers of Attorney and the various options and powers to be granted. Where an individual lacks capacity to grant a Power of Attorney, we also have vast experience guiding clients through the complex and involved process of applying to the court for Guardianship.
  • Dementia and other illnesses – dementia and dementia-related illnesses can bring a unique set of challenges for the suffered and their relatives. We offer advice on the practical support and financial assistance which might be available.
  • Care in the home or a residential setting – care arrangements are available in a variety of forms, including at home, in a residential setting or respite care, provided through the local authority or privately, or a combination of both. We have built up trusted relationships with a number of private care agencies and have excellent links with a number of registered nursing and residential homes in the Edinburgh area. We can also advise on the availability of NHS continuing care (also known as fully funded NHS care)
  • Financing care and claiming benefits/allowances – there are a variety of options for funding long-term care, whether at home or in a residential setting. We have in-depth knowledge of funding thresholds, as well as various benefits and allowances which can be claimed from local government and government departments, and regularly work in conjunction with social workers to ensure that the best care package (and financing of care) is in place.
  • Downsizing property – a move to a more suitable property is often part of the process of getting older. We provide assistance with all aspects of  a property sale and purchase. We have built up good working relationships with a number of organisations that can help with the practicalities of any house move (including move to a care home), such as the disposal or sale of surplus furniture and contents, or in arranging a move to a care home.
  • Vulnerable adults or abuse of the elderly - if there are concerns about abuse of the elderly or advantage being taken of vulnerable adults, the involvement of a solicitor can provide reassurance and protection against harm. Our team are available to recommend safeguards and remedies.
